    Morocco publishes amendments to criminal procedure code, set to take effect in December – The North Africa Post

    Morocco has officially published a new law amending and supplementing its Code of Criminal Procedure, marking a significant step in the country’s ongoing judicial reform agenda.

    The law was published in the Official Bulletin No. 7437 on September 8 and will come into force three months later, in December 2025.

    The legislative update introduces several structural changes to criminal proceedings, including new protocols for prosecuting financial crimes and revised conditions for civil action by associations.

    While the law has drawn attention from civil society groups and legal experts, particularly regarding its constitutional implications, the Ministry of Justice has framed it as a cornerstone of broader reforms aimed at modernizing the justice system.

    The new code complements ongoing efforts to revise the Penal Code, modernize legal professions, and digitize court operations.

    Among the reforms highlighted are stricter limitations on pre-trial detention, which will now be reserved for cases of strict necessity and require detailed justification. The law also promotes alternative measures to incarceration, in line with international best practices.
