The Archdiocese of Tanger has announced a new judicial decision regarding the dispute over the land on which the Al-Hamra School building in Tanger is located. On March 3, 2026, the Tanger Commercial Court of Appeal confirmed the first-instance judgment ordering the eviction of the occupant and anyone acting on their behalf, in favor of the Archdiocese.
According to an official statement, the court accepted the appeal on procedural grounds but confirmed the first-instance ruling on the merits, holding the appellant responsible for court costs. This decision strengthens the Archdiocese’s legal position in a case that has been before the courts for several years.
Previously, the Tanger Commercial Court had ruled to evict the defendant and anyone acting on their behalf from the property known as “Bariada”, located on Hassan II Street and the Belgium and Sidi Bouabid alleys in Tanger. The property was the subject of a legal dispute between the Archdiocese and the company involved in a private school project.
This decision follows an earlier ruling by the Court of Cassation in Rabat, which annulled the contract linked to the disputed property, marking a decisive turning point in the case. The Court of Appeal’s ruling now confirms the original eviction judgment.
The Archdiocese of Tanger emphasized that this decision represents an important milestone in the case, reaffirming the principle of respect for the law and the protection of rights upheld by judicial decisions issued by the Kingdom’s courts. It also reiterated its commitment to respecting legal procedures and judicial institutions in Morocco.
